
Metroselskabet receives decision in first part of arbitration case concerning M3
The partial ruling thus fully acquits Metroselskabet of the claim.
“With the insight into the decision that Metroselskabet now has, we are very satisfied with the partial ruling. The company and our external advisors are currently conducting a thorough review of the ruling to assess its full content,” says Mikkel Kjær-Jensen, executive director of Metroselskabet.
The construction contractor on the M3 Cityringen, CMT, brought the case before the arbitration tribunal on August 4, 2016, and submitted its first actual statement of claim in January 2019 with a claim that was supplemented in April 2021 with a number of additional claims. The arbitration tribunal, appointed by the Arbitration Board for the Construction Industry, has now issued a partial award on the first claim.
The remaining part of the arbitration case, which concerns, among other things, CMT's more general claims as a result of additional requirements and delays in the final part of the construction work, is not expected to be decided until 2028 at the earliest. As this is a pending arbitration case, Metroselskabet has no further comments at this time.

Background to the case
The case concerns the outer walls around metro stations and shafts, which were found not to meet the requirements of the contract and safety approval. This was dealt with by reinforcing the inner walls and top plates and installing ground anchors, which resulted in additional costs. The arbitration has now settled the dispute between CMT and Metroselskabet regarding responsibility and the financial consequences of this process.
The outstanding part concerns more general claims from CMT regarding delays, etc. in the final part of the construction work.
